    ''We finally wore Steven Spielberg down,'' said Gene Giaquinto, president of M.C.A. Home Entertainment, in explaining why ''E.T. the Extra-Terrestrial'' is to be released on video cassette in October.
    There has been, in Mr. Spielberg's words, ''a war'' to make him agree to put his 1982 film, the top box-office movie of all time, on cassette. Marvin Levy, a spokesman for Mr. Spielberg, who is in Spain directing his third ''Raiders of the Lost Ark'' movie, said: ''Steven told me: 'Since 1982, I've been inundated with three questions: When is ''E. T.'' coming to home video? Will there be a sequel? And what is Michael Jackson really like?' Steven was finally worn down by the world.''
    The cassette of ''E.T.'' is to go on sale worldwide on Oct. 27 for .95. A rebate from Pepsi-Cola will reduce the price still further, to .95. So far, ''Top Gun'' has had the lowest original release price of any major film. With a Diet Pepsi commercial attached to the movie, ''Top Gun'' was released at .95 and sold 2.9 million cassettes. ''E.T.'' will not carry a commercial. E.T. in Pepsi Commercials
    Pepsi-Cola approached M.C.A. almost a year ago, and the two companies have been working out the details ever since. M.C.A. said the rebate, which reduces the price to less than , allowed Mr. Spielberg to feel secure that most people will have access to carefully crafted cassettes rather than cheap low-quality pirated copies. Pepsi is also going to make commercials featuring the character of E.T.
    In terms of the number of cassettes sold, Disney's ''Lady and the Tramp'' is the current champion at 3.2 million units. The industry expects ''E.T.'' to sell at least 6 million cassettes, which would bring M.C.A. million.

    Mr. Spielberg's decision was based on more than a siege. The longer he waited, the more likely it was that pirated copies of his movie would turn up on cassette. ''We can't police the world,'' Mr. Giaquinto said. ''Whether Steven liked it or not, the movie was going to get out.''
    The Motion Picture Association of America, the trade group for the large studios, says its member companies lost more than billion to film and cassette pirates in 1987. The loss in home video alone was 0 million. Although the situation is improving, progress is slow. ''Three years ago, 80 percent of the cassettes in Japan were pirated,'' said Mark Harrad, director of communications for the association. ''Only 40 percent are pirate tapes today, but that's still a loss of 0 million.'' Guarding the Tape
    Although Mr. Giaquinto declined to be specific, M.C.A. is taking extraordinary measures to guard ''E.T.'' against pirates and to identify phony tapes, at a cost of more than million. The steps include an anti-copying system, holograms and symbols on the tapes and boxes, special security at warehouses and special guards when the tapes are moved, people familiar with the distribution plan said. Dubbing the cassette into more than a dozen languages and releasing it worldwide on a single day is also intended to discourage piracy.
    M.C.A. intends to protect the value of ''E.T.'' for future re-release at movie theaters by withdrawing the cassette from sale after six to eight months. In the past, movies have lost most or all of their theatrical value after being released on home video.
    ''E.T.'' has sold more than 0 million worth of theater tickets. With a new demand in home video, it seems likely to be a long time before the alien is allowed to go home.

HOWEVER, BY THEN THE COURT AND THE STUDIOS SEEN THE INDUSTRY GROW OUT OF CONTROL WHILE STILL IN COURT.  THEY WERE ALREADY PRODUCING THE VIDEOS AND JOINING IN THE BUSINESS IN A BIG WAY WHILE STILL IN COURT FIGHTING THE LEGALITY OF THE BUSINESS.
